1. Agreement to Terms

Welcome to ummi. These Terms of Use ("Terms") govern your access to and use of the ummi application, website, and related services (collectively, the "Service") provided by ummi ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

ummi is a running training application that provides:

• Personalized training plan generation based on your goals and current fitness
• Fitness assessment using VDOT methodology and integrated health data
• Race time predictions and pace recommendations
• Adaptive training adjustments based on your performance
• Integration with third-party fitness platforms (Apple Health, Garmin, COROS, and others)

3. Account Registration

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or in violation of these Terms.

4. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service
• Use any automated system, including "bots" or "spiders," to access the Service
• Impersonate any person or entity or falsely represent your affiliation with any person or entity
• Share your account credentials with others or allow others to access your account
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission

5. Third-Party Integrations

The Service may integrate with third-party platforms and services, including but not limited to Apple Health, Garmin Connect, and COROS. By connecting these services, you:

• Authorize us to access and use data from these platforms as described in our Privacy Policy
• Acknowledge that your use of third-party services is subject to their respective terms and policies
• Understand that we are not responsible for the availability, accuracy, or content of third-party services
• May disconnect these integrations at any time through your account settings

6. Health and Fitness Disclaimer

By using the Service, you acknowledge and agree that:

• Training plans and recommendations are generated algorithmically and may not be appropriate for your individual circumstances
• You should consult with a qualified healthcare provider before beginning any exercise program, especially if you have any medical conditions or concerns
• You are solely responsible for your own health and safety during any physical activities
• Race time predictions and fitness assessments are estimates and not guarantees of performance
• We are not liable for any injuries, health issues, or other damages that may result from following training plans or recommendations

7. Intellectual Property

The Service and its original content, features, and functionality are owned by ummi and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. This license does not include the right to:

• Modify or copy the materials
• Use the materials for any commercial purpose
• Remove any copyright or other proprietary notations
• Transfer the materials to another person or "mirror" the materials on any other server

8. User Content

You retain ownership of any content you submit, post, or display through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to submit User Content and that such content does not violate any third-party rights or applicable laws.

9. Subscription and Payment

Certain features of the Service may require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate billing information
• Authorize us to charge your payment method for recurring subscription fees

Subscription fees are billed in advance and are non-refundable except as required by law. You may cancel your subscription at any time through your account settings, and cancellation will take effect at the end of the current billing period.

10. Limitation of Liability

To the maximum extent permitted by law, ummi and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Personal injury or property damage
• Any damages arising from your use of or inability to use the Service
• Any conduct or content of third parties on the Service

In no event shall our total liability exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We do not guarantee the accuracy, completeness, or usefulness of any training plans, predictions, or other information provided through the Service.

12. Indemnification

You agree to indemnify, defend, and hold harmless ummi and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or through your account settings. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located within the United States.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ummi regarding the Service and supersede all prior agreements, representations, and understandings.
